These Terms of Service ("Terms") govern your access to and use of Butterfield AI's website virtual assistant widget and related services (the "Service"), provided by Butterfield AI, a sole trader business operating in the United Kingdom ("we", "us", "our"). By signing up for or using the Service, you ("you", "your", "Customer") agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Service.
Butterfield AI provides a software widget that businesses can add to their websites to provide automated, AI-powered customer interactions, including answering enquiries, capturing lead information, generating indicative quotes, and assisting with appointment booking requests ("the Widget"). The Widget is powered by third-party artificial intelligence technology.
The Service is provided on a subscription basis as described at butterfieldai.com, with plans and pricing subject to change with reasonable notice to existing customers.
To use the Service, you must complete our onboarding process and provide accurate information about your business, including but not limited to your services, pricing, hours of operation, and contact details. You are responsible for the accuracy of this information, as it directly informs the responses given by your Widget to your customers.
You may update your business information at any time via your personal update link, provided to you upon signup.
New subscriptions include a 14-day free trial period, during which you will not be charged. Your payment card will be charged automatically at the end of the trial period unless you cancel before it ends.
Subscriptions renew automatically on a monthly basis. You may cancel at any time; cancellation will take effect at the end of your current billing period, and you will retain access to the Service until that date. We do not provide refunds for partial billing periods except where required by law.
Prices are shown exclusive of VAT where applicable. We reserve the right to change our pricing for new subscriptions; existing subscribers will be notified of any pricing changes affecting them in advance.

The Widget uses artificial intelligence to generate responses to your customers' enquiries based on the business information you provide. While we take reasonable steps to support accurate and appropriate responses, AI-generated content may occasionally be inaccurate, incomplete, or unexpected. You are responsible for reviewing the information you provide during onboarding and for monitoring conversations to ensure the Widget represents your business appropriately.
Quotes, estimates, and pricing information given by the Widget are indicative only and do not constitute a binding offer unless you separately confirm them with your customer.
We are not liable for any loss, damage, or dispute arising from inaccurate, incomplete, or inappropriate AI-generated responses, save where such liability cannot be excluded by law.
When your customers interact with your Widget, certain personal data (such as names, phone numbers, and email addresses) may be captured and shared with you via email notification, in order to facilitate lead management on your behalf. You act as the data controller in relation to your own customers' personal data, and are responsible for complying with applicable data protection laws (including UK GDPR or other relevant regimes) in respect of how you use that data. We act as a data processor in this respect, processing data solely to provide the Service to you.
The Widget, our website, and all associated software, code, and content are the property of Butterfield AI and are protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of the underlying Widget software; you are granted a limited, non-exclusive, non-transferable licence to embed and use the Widget on your own website(s) for the duration of your subscription.
We aim to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service depends in part on third-party infrastructure and AI providers, and we are not liable for outages or limitations caused by those third parties.
We may suspend or terminate your access to the Service if you breach these Terms, fail to make payment, or use the Service in a manner that we reasonably believe poses risk to us, other customers, or third parties. You may cancel your subscription at any time as described in Section 3.
To the fullest extent permitted by law, Butterfield AI's total liability to you arising out of or in connection with these Terms or the Service shall not exceed the total fees paid by you in the three (3) months preceding the event giving rise to the claim. We are not liable for any indirect, special, or consequential loss, including loss of profits, business, or goodwill.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
We may update these Terms from time to time. Material changes will be notified to active subscribers by email. Continued use of the Service after such changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, save where mandatory consumer protection laws in your jurisdiction provide otherwise.
